Please read these terms carefully before creating listings, publishing single-property pages, generating marketing collateral, or deploying WhatsApp automation on PropOmni.

1Technology Platform Safe Harbor (Not a Real Estate Brokerage)
PropOmni is an independent software-as-a-service (SaaS) and generative artificial intelligence platform designed to produce marketing collateral, single-property landing pages, and automated WhatsApp communication workflows.
Crucial Safe Harbor Clarification: PropOmni is NOT a licensed real estate broker, property dealer, legal conveyancer, mortgage lender, or land surveyor. PropOmni does not own, inspect, sell, lease, or verify title for any properties advertised on the platform. All commercial agreements, viewings, and real estate transactions take place strictly and exclusively between independent buyers, sellers, and licensed listing brokers.
2Publisher Responsibility & Authority Representation Warranty
Any individual, brokerage firm, or property owner who uploads media, enters specifications, or generates marketing assets on PropOmni ("Publisher") legally warrants and represents that:
- They hold valid, verifiable, written authorization from the registered legal titleholder or developer to solicit inquiries and advertise the property.
- All stated facts, measurements, amenities, pricing, handover dates, and regulatory permit numbers are 100% truthful, accurate, and up-to-date.
- They possess all necessary intellectual property rights, photographer releases, and privacy permissions for all uploaded photographs, videos, and architectural floorplans.
- The property is free from undisclosed pending judicial injunctions, criminal seizures, or title disputes that would render marketing deceptive or unlawful.
3AI Co-Pilot Status & Mandatory Human Verification
PropOmni incorporates multimodal artificial intelligence algorithms to assist in generating advertising copy, localized translations, headline options, and feature summaries.
AI outputs are preliminary drafts. By publishing a live landing page (`/v/[slug]`), printing a PDF flyer, or broadcasting social media captions, the Publisher certifies that they have physically reviewed and adopted the content as their own verified work. PropOmni disclaims all liability for AI hallucinations, automated approximations, or typographical discrepancies.
4Jurisdiction-Specific Regulatory Mandates (India)
Real Estate (Regulation and Development) Act, 2016 (RERA): In accordance with Section 10 and Section 11 of the RERA Act, all Indian real estate brokers and promoters advertising under-construction or registrable properties must display a valid State RERA Registration Number.
Publishing false pricing or unauthorized project claims violates consumer protection laws. The Publisher warrants sole legal liability for all claims before State RERA authorities and Consumer Disputes Redressal Commissions.
5WhatsApp Automation & Buyer Contact Protection
PropOmni equips listings with an interactive WhatsApp qualification bot. The Publisher explicitly agrees:
- Buyer phone numbers and viewing schedules generated via the platform may only be used to facilitate genuine walkthroughs and inquiries for that specific property.
- Brokers are strictly prohibited from exporting, selling, or spamming buyer contact details with unsolicited promotional broadcasts or unrelated services.
- PropOmni stores lead inquiries securely and routes them exclusively to the authorized listing broker.
6Monetization, Subscription Packs, Fair Use Policy & Refund Terms
PropOmni grants every new verified broker account 1 Free Listing Welcome Pass (valid for 30 days of live landing page hosting with watermark). Additional properties may be unlocked on an individual per-property pass basis (₹499 in India via UPI / 99 AED in UAE / R$ 39 in Brazil / $12 International via Stripe) or via recurring monthly Pro and Agency subscription tiers.
To safeguard shared cloud compute resources, ImageKit CDN storage, and Google Gemini AI Vision infrastructure against automated scraping or multi-broker account exploitation, all Unlimited and Agency subscription tiers are governed by the following strict Fair Use Quota:
- Listing Creation Velocity: Up to 30 new AI-generated property listings per monthly billing cycle.
- Active Hosted Properties: Up to 50 concurrently published, active landing pages at any one time.
- Anti-Scraping & Account Sharing Prohibition: Automated bulk data scraping, headless bot posting, or syndicating account credentials across multiple independent brokerage franchises is strictly forbidden and constitutes cause for immediate termination without refund.
- Enterprise Allocation: Large brokerages requiring volume beyond 30 properties/month may contact enterprise support for dedicated compute clusters.
Because digital marketing assets, PDF flyers, and live landing pages are generated instantaneously upon payment confirmation, fees for successfully unlocked listings and subscription periods are non-refundable once live assets have been accessed.
7Limitation of Liability & Intermediary Safe Harbor
To the maximum extent permitted by applicable law, PropOmni, its founders, and affiliates shall not be liable for any indirect, incidental, punitive, or consequential damages arising from property transactions, defective building construction, financial deposits paid to rogue sellers, or server downtime. PropOmni's total aggregate liability under any circumstance shall not exceed the fees paid by the user in the preceding thirty (30) days.
Article 8: Governing Law & Dispute Resolution
Domestic Indian Jurisdiction (Exclusive Venue): This Agreement and all rights and obligations arising hereunder shall be governed by and construed in accordance with the substantive laws of the Republic of India. Any suit, legal action, or judicial proceeding arising out of or related to this platform shall be instituted exclusively in the competent courts having territorial jurisdiction in Eluru, Andhra Pradesh, India. The parties explicitly waive any objection to the laying of venue or forum non conveniens in such courts.
International & Cross-Border Parties: For users or claims originating outside the territory of India (including UAE, Brazil, Europe, and the Americas), PropOmni reserves the right to elect that any dispute be finally settled under the Rules of Arbitration of the Singapore International Arbitration Centre (SIAC) by one arbitrator appointed in accordance with said Rules. The seat and venue of arbitration shall be Singapore, and the proceedings shall be conducted in English.
